When can I modify child support? We hear this a lot from both the payors and the recipients. We will deal with this one by one:
- If you are paying child support and want to modify, you need to show a substantial change of circumstances, as set forth in our March 22nd blog regarding modification of alimony.
- If you are the parent receiving child support and want to modify, you will also need to show a substantial change of circumstances, as set forth in our March 22nd blog regarding modification of alimony.
If one or more the children have reached the age of emancipation, child support always reduces. It is not cut in half or thirds, as some people think, but must be assessed per the Florida Child Support Guidelines. More recent court orders already have set forth a sliding scale within their judgments. However, the numbers set forth in those judgments may be incorrect, depending on the current income of the parties. Older judgments do not have a sliding scale, so we must start from scratch.
